Nobel Affiliate Program Rules and Policies

Nobel is willing to authorize any individual or legal entity (the Affiliate) to participate in the Nobel Affiliate Partner Program (Program) granted that the Affiliate accepts the Nobel Affiliate Program Rules and Policies (Rules and Policies) mentioned herein.

By participating in the Program, the Affiliate agrees:

• To comply with all applicable laws and regulations, whether foreign, federal, state or local, applicable to the activities performed hereunder.
• To ensure that all materials presented on his website(s) or in any email or other marketing communications represents Nobel in a professional, accurate and positive manner.
• Not to bid on Nobel trademarked terms and misspellings for search marketing campaigns such as Nobel, Nobelcom, Noble, Noblecom, Nobell etc . Misspellings include those with missing characters, extra characters, wrong character sequences, and where the wrong key is pressed. It is prohibited to bid on competitors' brand terms. The Affiliate also agrees not to include the above mentioned keywords in the display URL for purchased keywords.
• Not to use any unsolicited or spam email to promote Nobel. The Affiliate represents and warrants that: (a) each addressee on an e-mail list has opted-in to receive e-mails from the Affiliate; (b) upon request by Nobel, the Affiliate will promptly provide verified opt-in statuses for all recipients of all current mailing lists used to promote Nobel products; (c) each e-mail sent by the Affiliate will contain clear instructions for addressees to unsubscribe from receiving future e-mails. The Affiliate must not use the Nobel brand name or typos in the "From" address line. All Affiliate e-mail correspondence must contain the Affiliate's e-mail addresses.
• Not to use or own a web site that is confusingly similar to the official Nobel websites, or which may mislead third parties into thinking the Affiliate is Nobel or an official partner of Nobel. This includes copying and framing any of the Nobel web pages.
• To comply with Nobel's trademark, copyrighting and other intellectual property criteria and requirements and to acknowledge that Nobel owns and will retain all rights, titles, and interests in all Nobel content, including, without limitation, any proprietary rights which may be developed in the future. Use of Nobel content applies exclusively to the benefit of Nobel, and the Affiliate obtains no rights to Nobel content through use thereof.
• Not to use or own copycat sites, or use any content or images from any Nobel websites, except for content and images which have been expressly allowed for use by Affiliate partners. The Affiliate may use the links and/or banner ads Nobel provides to Affiliate Partners only in the form in which they are provided.
• Not to use sites under construction, sites that show or cause any type of error, doorway pages, sites or pages with automatic redirect.
• Not to promote Nobel on any websites, marketing materials or communications which: are designed to distribute or promote spyware, adware, trojans;contain misleading or deceptive marketing activities;are in any way involved in illegal activities;violate the intellectual property rights of Nobel or a third party;contain any offensive or inappropriate content or is otherwise involved in any matter considered to be offensive or inappropriate by Nobel.
• Not to commit fraud or submit fake transactions. Affiliates are not allowed to recruit customers and then make a payment for the customers. The customers have to create their account and make the payments by themselves. Commission will not be paid for customers that don't fulfill these requirements, and the Affiliate will be removed from the program.
• To include, on all Affiliate websites that endorse Nobel or Nobel's products, the following disclaimer: "The Company receives a small commission for any Nobel sales generated by this site". The Disclaimer must be clearly and conspicuously disclosed on the Affiliate's website(s). Pursuant to FTC's guidelines, "Clearly and conspicuously" means it will be read and understood by the reader. In order for the disclaimer to be deemed as clearly and conspicuously disclosed on the Affiliate's websites, the reader should be able to see both the product review/endorsement and the link. At the same time, the font should be readable in both size/type and color, and not be significantly smaller than the review/endorsement itself. Moreover, the disclaimer cannot be buried in a link that has no relationship via its placement to the review/endorsement, or that, while included near the review/endorsement, does not explain in some way what the link is designed to disclose. Nobel reserves the right to review Affiliate's compliance with the hereby requirement and, in case of Affiliate's failure to comply, to take any action in this regard. By participating in the Program, the Affiliate agrees to indemnify and hold harmless Nobel, its officers, directors, employees, subsidiaries, Customers, Partners, Suppliers, and other Affiliates (the "Indemnified Parties"), from and against any and all liability, costs, and settlements, including, without limitation, reasonable attorneys' fees and accounting fees, incurred by the Indemnified Parties in connection with any claim arising out of AffiliateTo include, on all Affiliate websites that endorse Nobel or Nobel's products, the following disclaimer: "The Company receives a small commission for any Nobel sales generated by this site". • Nobel may amend the Program Rules and Policies at any time by publishing a new version on website. Continued participation in the Program following the effective date of a new version will constitute the Affiliate's acceptance of the new version, and all amendments to the prior forms of the Program Rules and Policies. If any amendment made by Nobel is unacceptable, the Affiliate will acknowledge this by exiting the Affiliate Program.
